1. Who we are

This website, bouwensa.co.za, is operated by Bouwen Construction (Pty) Ltd ("Bouwen", "we", "us"), a building contractor based in Paarl, Western Cape, South Africa. For the purposes of POPIA, Bouwen is the responsible party for the personal information collected through this website.

2. What we collect

We only collect personal information that you choose to give us. When you send an enquiry through the form on this website, we collect:

• your name;
• your email address;
• the type of project you are enquiring about; and
• the description of your site or project that you provide.

If you email us directly, we receive your email address and whatever you include in your message. Please do not send us special personal information (such as health, religious or biometric information) or identity numbers through the website.

3. Why we collect it

We use your information to respond to your enquiry, prepare a scope, programme or price estimate, and communicate with you about a potential or existing project. We process it on the basis of your consent, given when you tick the consent box on the enquiry form, and because it is necessary to take steps at your request before entering into a contract with you.

We will not use your information for unrelated purposes, sell it, or send you marketing without your separate consent.

4. Who we share it with

We do not sell or rent your personal information. It is shared only with:

• Service providers (operators) who host this website, process form submissions and deliver our email, acting on our instructions and under appropriate confidentiality and security obligations;
• Professional consultants and subcontractors (such as architects, engineers or quantity surveyors) where this is needed to respond to your enquiry or carry out your project, and only with your knowledge; and
• Authorities where we are required to by law.

5. Transfers outside South Africa

Our website hosting and form-processing provider, Netlify, Inc., stores data on servers outside South Africa, including in the United States. By submitting an enquiry, you consent to this transfer. We use providers that are bound by data protection obligations substantially similar to those in POPIA, as required by section 72 of the Act.

6. How long we keep it

We keep enquiry information for as long as needed to respond to you and, if you become a client, for the duration of the project and any period required by law (for example, tax, building and warranty records). Enquiries that do not lead to a project are deleted within 24 months, unless you ask us to delete them sooner.

7. How we protect it

We take reasonable technical and organisational measures to protect your personal information against loss, misuse and unauthorised access. This website is served over an encrypted (HTTPS) connection. No method of transmission over the internet is completely secure, but we will notify you and the Information Regulator if we become aware of a security compromise affecting your information, as POPIA requires.

8. Cookies and tracking

This website does not use advertising or analytics cookies, and does not track you across other websites. Our hosting provider may keep standard technical logs (such as IP address and browser type) for security and performance purposes.

9. Your rights

Under POPIA you have the right to:

• ask whether we hold personal information about you and request a copy of it;
• ask us to correct or delete information that is inaccurate, out of date, incomplete or unlawfully obtained;
• object to the processing of your information, or withdraw your consent at any time (this does not affect processing that took place before you withdrew it); and
• lodge a complaint with the Information Regulator.

11. The Information Regulator

If you are not satisfied with how we have handled your personal information, you may complain to the Information Regulator (South Africa): inforegulator.org.za, email enquiries@inforegulator.org.za.

12. Changes to this policy

We may update this policy from time to time. The latest version will always be published on this page, with the date it was last updated.
